Posts: 910 Location: Hastings, mn, 55033 | i recently completed a deal for a st croix jerkbait rod with a guy who had posted on one of these boards (cant remember if it was this board or one of the others). he had stated to me the rod was a replacement from st croix for a broken rod, and that it was new with tags still on it. he said it was a couple years old. well when i get the rod, there are no tags on it, it has scuff marks on the blank and one eye. dirty cork on the handle. and it is a premier with the maroon and gold wraps, and gold st croix logo. according to folks i've talked to said that st croix hasnt used those wrap colors/logo color for at least 7-8 years and possibly longer. after receiveing the rod i emailed the guy back and asked if we could work out a return/refund. i had paid $60 for the rod + $20 shipping. i asked that he cover the $20 shipping back to him, and refund the $60 purchase price. that way neither of us is out more than the other, both would have $20 into shipping costs. i thought i was being fair in that proposal since i feel it was an outright misrepresentation on what i was buying. had i known it was a USED rod that was at least 7 years old i would never have bought it for that price!! am i out of line for asking to work something out on this, or is the seller in the wrong for first misrepresenting what he was selling, and then refusing to at least try and find a fair compromise. sorry if this isnt the right forum to place this in. just very frustrated and needed to vent as well as hear others opinions on to whether i am wrong for being upset. | ||

Posts: 295 Location: mad chain | Castmaster I would feel the same way that you do. When ever I sell a Item I try to be as honest about the item as I can, a long with a real nice pic. A pic is worth it's weight in gold. If someone is not happy with the item I fully refund the item. | ||

Posts: 910 Location: Hastings, mn, 55033 | thanks guys! the only thing the guy will even do is just send a copy of my email back to me. so i know he's getting them and taking the time to copy and send back, but wont even say anything. just frustrating after all the fair and honest deals i've found through sites such as this to end up with a bum deal, but i guess its bound to happen anywhere at some point. i should probably be thankful this is the first time i've had to deal with something like this. overall i feel the vast majority of guys on these firoums do describe things honestly. and yes pics are preferred, but in this case i just took him at his word the rod was new, with tags still on, so figured i didnt really need to see a pic. i'm guessing that had i requested one it probably wouldnt have been of the rod i received anyway. the amount of difference between what it was made out to be and what it is are far enough apart that i 'm assuming it was an intentional thing, not a miscommunication or difference in one guys "used" and anothers. rod was said to be new, and its certainly not. | ||

Posts: 93 | I say: do try to find out what the username of this seller was and on what board you saw the topic. That way other potential buyers, buyers that have the right intention, know who to ignore. Hope it will work out for you after all J | ||

Location: Contrarian Island | I would say you have a reason to try and get some money back...I have bought and sold quite a few items from this forum and I have yet to have anything go wrong..I think 99.9 % of the guys that use this are honest and you probably got the one bad apple....if the rod wasn't as described I would continue to hound the guy.... | ||

Posts: 910 Location: Hastings, mn, 55033 | i heard back from the seller. apparently there is something goofy with either his email or mine. when he would reply to the email, it would paste my email to him at the top, then list the other emails between us, and would put his new response all the way at the bottom. so to me it looked like he was just copying my email to him and sending it back, to let me know he got them, but had nothing to say. at any rate, he is now willing to refund $50 of the purchase price, which still doesnt seem quite fair, but it might be better than nothing. then again i'd now be out $30 with nothing to show for it, i may be better off to just eat it and keep the rod, and learn to be a bit more careful in the future. although like others have said i think this is a RARE occurence! | ||

Posts: 2361 | Covering the shipping is MORE than you should be expected to do. This guy out and out attempted to screw you by #1 missrepresenting the rod as new, and #2 being a couple years old with tags still on it. In this case he should cover, not only the full cost, but also the shipping cost, putting him out $40 with nothing to show for it, and that is fair since he was the one doin the lyin. As to what is the best course for you, is something you have to decide. I was one that also got an "old" St. Croix rod, represented as new. I knew I got took but decided to just keep the rod and use it. It was the same type of deal where it was an older model, but I believe it was an unused rod so the seller had at least partially described it fairly, but I believe this seller knew it was the older model and several years out of production and chose not to come forward with that information. I decided for the price I could live with the rod, but I wasn't happy. In your case, this guy has clearly attempted to screw somebody, and you are the one. If he is a poster on the boards of note, I would simply e mail him back demanding full refund, and I think your willingness to ship one way is MORE than your responsibility in this transaction. Also make it clear to him that if a full refund is NOT received that you are going to make his name available to anyone that wants it, or post it on all the major boards, even though it might get pulled. I think that for his reputations sake he will see it your way. If not, everybody needs to know about the guy anyway. I have sold, bought, traded a lot of stuff over the internet in terms of fishing baits, both usable and collectable. I have only had a couple deals where I felt the other side was so far out of line that I was unhappy. One was a bait trade, where a bait I was getting, represented as new, was actually re painted, had refletive tape added, and was coated with hard coat. The bait was in ok condition and would have been acceptable even with the repaint but the bait didn't work with a hoot and sank fairly quickly, and those things were problems. We swapped back and both of us were out shipping X2, and it was unfortunate because I think the guy I traded with was unhappy, but, had he represented his bait fairly, I might have still made the trade originally and would have had no reason to complain, but he hadn't been accurate when telling me what he had to trade, so, it wasn't good for either of us. But I felt it was as square as I needed it when we swapped back. Not happy about the $6, but fair enough for me, and I believe the guy trading me felt that his representation of the bait was fair, I never felt he was trying to take advantage of me. The other time was when I advertised a bait here, which was a collector and user bait, and had a well known poster, and now a guide e mail that he wanted it and would buy it. Then he sat for another 6 weeks or so, and after two more e mails, where he claimed he was going to purchase, and was sending the check two more times, the goof never came up with the money. I finally sold it to another fellow but was definitely unhappy with MR. "I will buy it" for pulling the crap he did. I am suspicious he spoke before considering his finances and was having a problem coming up with the money(I think around $50). If he would have been honest and explained that he had financial problems I would have been fine with that. If he would have even told me that he decided he couldn't buy it or didn't want it at the time, I would have been alright with that too, not happy but ok. As it was, I was trying to get the money out of the bait and ended up having to wait two months(I was buying or going to buy something else), and I thought his continuing messages claiming, yes he was going to send the money, were at the least CHARACTER FLAWS. I will never do any type of business with this guy again, and every time I see somebody endorse him on the boards I think back to my little episode and wonder who the guy is screwing these days, because generally people that do this type of thing don't do it just once. Now that I have vented I feel much better. I have to say, the large majority of deals I have made with actual fishermen have been very satisfactory. I think generally fishermen tend to be very honest in terms of tackle deals, and not only want their trading partner to be happy but also want to be well thought of by those they deal with. Then he sat for another 6 weeks or so, and after two more e mails, where he claimed he was going to purchase, and was sending the check two more times, the goof never came up with the money" maybe i should add this. this sale was originally set for back in sept. it was to be a trade of a creepinstein for the rod. the creepinstein i was atrading to him was up north and i explained it would be a while befroe i could get it out. he said that was no problem, he wasnt in any hurry. then in late sept or early oct. i had a computer meltdown and lost all information for him. after i got back up and running, i didnt hear from hi so i fgiured i had missed out. then just after x-mas i get an email asking if i ever shipped the bait as he never got it. i explained what had happened, again he said no problem. by this time i had already traded the lure to a friend, so the cash price was agreed on. so i do appreciate his patience, although i somewhat suspect he held it because he knew it wasnt what it was made out to be. ay any rate, it surely wasnt my fault or intention to take that long, had he emailed me sooner it would have been taken care of sooner. plus at no point during that time was either of us out anything, he had his rod i had my $$. if when he emailed me after x-mas he had said the rod was sold, there certainly wouldnt have been any hard feelings on my part, as i certainly wasnt expecting the deal to even be in place at that point. to me that portion of events is kind of irrelevant, because the rod didnt morph from what it was purported to be into what it is during that time!!
