Posts: 786 Location: Minnesota | Patents in the lure world would be VERY hard to hold on to. Reason is, you can change a bait slightly and it is now unique from the claims of the original IP. Also, most stuff has been done in the past and it would be very hard to determine if your IP was unique due to the lack of public/searchable information on your bait/innovation. I am watching the CHATTER bait right now. They are getting ripped to pieces IMO in the patent world. They state they have an original lure but everyone is copying them now. I for one have seen this bait in much older form. Not sure what they thought was original and patented here. If I wanted to come out with a CHATTER bait all I have to do is look at or copy the old ones I have seen and I am free and clear as I am practicing prior art. Also, if this old art is out there and similar, the CHATTER bait has nothing. This one will be interesting to watch. With the CHATTER bait as an example, here is your main problem. They will spend and easy $100-$200k defending that patent from the other big boys who are copying. The small guys get a letter and basically just stop because who has $20k to retain an attorney to fight it for you... The big boys have plenty of money to invalidate or fight this patent. At the end of the day you need something VERY unique that you have the $$$ to defend yourself OR something you can sell to the big boys. JMO, James PS-I don't know a lot about patents but I have 6 and have self defended one of my small companies (not a lure company) against two infringement accusations on products I sell and won. So, I know enough to be dangerous to myself and my businesses  | ||

Posts: 786 Location: Minnesota | That is not a patent number so I could not find it to read the claims (patent 425,167 was issued on April 8, 1890  ).... So anyway, good example of a patent that cost a lot of money and means nothing. Not being an ass but, it would not be rocket science to get around a way to weight a bukctil and make a good product that works and thus that company protected nothing of value. IMO most patents are a waste of money unless they are the bottle neck patents or core technology IP. Some others out there are good but I would say 95% of patents are a waste of money. Most of the time they look good on a resume and that is about it. Please post that right IP #. I think it woudl be interesting to read that one. James | ||
