Subject: New bait company questions?


Can anyone tell me what is involved in starting a fishing lure compnay? What I make are surface baits that are basically identical to Frenchy Lemay's "LeLure". I make globes, thumpers, toppers, creepers, and so on. What I am looking for is whether there are laws or copyrights on bait names or the style of the bait.

you may want to check out this website here: http://www.uspto.gov/patft/index.html

and try finding a lawyer that specializes in patents. A handmade lure isn't a copy because it's never 100% the same but if you intend to sell identical lures (machine-made), that may be a problem. I do say "may", because swim whizz and believers have the same molds. Most tallywhacker-type lures look similar but are just always a bit different. Therefore make sure you know what you are getting into. Good luck!

There is no way to put a patten number on a fishing lure. The only thing you can do is to have the company's name copyrighted so someone can't take your name away from you. From there contact the IRS and have them set you up with the fedral exise tax form for your 720 tax. This is a 10% tax every 1/4 on your gross sales that goes back to the states resources. It suck's having to pay this but it's a must!
