5-10hp isn't much of a difference but its still above the max, just like speeding they can get you going 5 over. Sometimes you can get a boat re-certified for a little more power if you try and work with the coast guard. I doubt you would ever have a problem with the law out on the water, but if it ever came down to an insurance claim you could get stiffed.
